Data Protection
In the following, we inform you about which personal data we collect and store from you when you use our portals, and how we use this data, as well as to whom we may pass on this data. You will also receive information on your rights regarding the use of your data:
1. Scope and Purpose of Processing Personal Data
a. when visiting our portals
If you use our digital services without providing further information, the web server technology we use automatically logs general technical visit information in so-called log files. This includes, among other things, the IP address of the device used to access the site, information about the browser type, the internet service provider and the operating system used, which digital services were accessed on our site, referrer/exit pages, the time and duration of the visit.
The collection and processing of this information serves the purpose of enabling the use of our websites (establishing a connection), ensuring and increasing the security and stability of our systems and services, analyzing the use of our services, collecting general demographic information, and enabling the optimization of our internet presence (in particular, but not exclusively, product improvements, marketing measures, target group-specific advertising, etc.), as well as for internal statistical purposes. User identification does not take place. Likewise, as a matter of principle, no connection is made between this automatically collected information and personal data stored by us.
An exception to this basic rule may exist if you already have a registered user account on one of our portals. Further detailed information regarding the processing of personal data of registered users can be found in the following sections 1.b and 1.c. If you send a message to a third party (e.g. an advertiser) via a corresponding function of our portal, these messages may be stored by us. You can also obtain free services on our portal. Your personal data (e-mail address, telephone number, etc.) disclosed when using a free service or with the message may be used by us, for example, for marketing and analysis purposes. More detailed information on the processing of personal data for marketing and analysis purposes can be found below in section 4.
Information published by you on our portal may be published by us on other platforms and in other media, possibly in adapted form. If you access our portals with a mobile device, we will ask for your consent before we determine your exact location using GPS or other tools. In addition, we use cookies and analysis tools (e.g. Google Analytics) when you visit our portals. See sections 8 and 9 of these data protection provisions for more information.
b. when registering a user account
For personalized services or access-protected areas, or for processing inquiries and administering orders, your registration and thus the creation of a user account may be required. This requires the input of certain personal data.
This applies, for example, to
- your email address, which can also serve as your username,
- password
as well as, depending on the context and offer, other details such as
- first and last name
- address (full postal address, zip code, city)
- phone number
- date of birth
- gender
- information about subscribed newsletters or other advertising
- language preferences
In addition to the information marked as mandatory for the use of a specific digital offer, you can voluntarily enter and store further personal data.
We use the data to process and administer our digital services, to verify the plausibility of the data entered, i.e. for the establishment, content design, processing and modification of the contractual relationships concluded with you via your user account, and in the case of paid services, for proper invoicing.
If you post contributions (comments, photos, videos, etc.) via corresponding functions of our portals to share them with other users, we would like to point out that such data once published on the internet may still be accessible to third parties, for example via search engines, even if you or we have deleted or anonymized them.
By confirming the completion of your registration for the collection and modification of your user account details, you guarantee the factual accuracy of the information you have entered.
c. when using a portal as a registered user
During the use of the portal by registered users, we collect data for statistical reasons to enable the smooth functioning of the portal, as well as for the analysis, optimization, and personalization of the use of our offers and services. For example, we collect data on whether and how you use our digital offers, in particular which functions and which advertisements you perceive and how. Further information on the processing of this personal data can be found below in section 1.d and section 4.
If you use our portal as a registered user, statistical data may be visible to other registered users and may be collected and evaluated by us.
d. upon purchase / subscription / order
If you purchase a product or a paid service on our site, the provision of data such as first and last name, address (full postal address, postcode, city) and possibly further data is mandatory, as we need this for the processing of the contract with you.
If you choose an online payment option such as credit card or PayPal for the purchase of a product or a paid service, payment is made via the respective provider's online payment system. In this case, the processing of personal and payment data takes place directly via the provider of the respective payment system.
We do not know or store your payment details. In each case, the data protection provisions of the respective online payment system provider also apply. If you are registered and have a user account, we can store your data in the user account of our ERP system for the next purchase / contract conclusion. In any case, we store all information about your current and previous purchases and contract conclusions, i.e. the products, the services, the number of products and services per purchase, the payment amount. We are entitled to use this information for marketing and analysis purposes. Further information on marketing and analysis purposes can be found below in section 4.
e. when participating in sweepstakes, competitions, etc.
We use the data you provide for the organization and execution of the events as well as for the notification and/or publication of the winners on our portals, by direct notification or on social networks. If you have allowed us to do so, we may use your data according to sections 2 and 4 and also pass it on according to section 3.
2. Direct Marketing and Online Advertising
Upon your registration or order, we may also use your personal data for personalized advertising measures. This includes the personalization of advertising via email, such as emails with general information or promotional content (newsletters), via telephone, postal mail, fax, text messages, picture messages, and instant messaging services, as well as the delivery of personalized content and advertising on our portals. For this purpose, we may automatically evaluate information known to us about your user behavior on our portals to avoid sending you inappropriate advertising. You can find these processing operations in section 4.
By registering a user account, we may subscribe you to one of our newsletters, and your email address may also be used for our own advertising purposes. You can opt out of this by unsubscribing after receiving the first newsletter. At the end of every email we send, there is a link that allows you to unsubscribe from the newsletter at any time.
You can also unsubscribe from the newsletter at any time by sending an email to ideas@novidarte.ch. Unsubscription is possible at any time. We are entitled to commission third parties with the technical processing of advertising measures and advertising for ourselves and are entitled to pass on your data for this purpose.
3. Transfer of Data to Third Parties
We cooperate with other companies or individuals, or commission other companies or individuals with the processing and storage of data. These may have access to your personal data or usage data, but only to the extent necessary for the performance of their tasks. We may use and pass on information collected from you and data collected about you or your user account within the framework of our usage measurements pursuant to Section 1 above for customer care, personalization and marketing purposes. Data processing by other companies is described below in Section 4.
A transfer to other companies in accordance with the present Section 3 generally takes place with pseudonymized or anonymized data. This means that the data can no longer be assigned to you without the addition of further information.
In addition, we pass on your data to third parties if this is necessary for the performance of the contract. For this purpose, we may pass on the necessary data to transport companies, banks and other service providers. These service providers use your data exclusively for order processing and not for other purposes.
Insofar as this is necessary for the purposes mentioned in sentence 1, the data may also be transferred abroad, for example to enable the delivery of goods.
More information regarding transfers abroad can be found in section 5. Your personal data that you provide to us will not be sold, rented, or traded by us outside of our company and affiliated companies.
Apart from the transfers described above, we only pass on your personal data if you have expressly consented, if there is a legal obligation to do so, or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship.
In the event of a sale, merger or other reorganization of some or all of our company's assets, personal data may be transferred, sold or otherwise shared with third parties as part of that transaction or reorganization. If we perform in advance, for example in the case of a purchase on account, we may obtain a credit report from a credit agency on the basis of mathematically statistical procedures to protect our legitimate interests. For this purpose, we transmit the personal data required for a credit check to a credit agency and use the information received about the statistical probability of a payment default for a decision about the establishment, execution or termination of the contractual relationship.
The credit report may contain probability values (score values) calculated on the basis of scientifically recognized mathematical-statistical procedures, and whose calculation includes, among other things, address data. Your legitimate interests are taken into account in accordance with legal provisions.
4. Processing of your personal data for marketing and analysis purposes
Our company aims to continuously improve and tailor its offerings to your needs. For this purpose, user-specific historical and future data available to us can be continuously linked using various analysis tools, and user behavior across all offerings can be analyzed, aggregated, pseudonymized and anonymized.
To improve our data basis, we may draw on publicly available data or data from third-party providers. The insights gained from your use of our offerings can be used and evaluated in the context of user behavior analysis by other participating companies.
Such data processing is primarily carried out with pseudonymized or anonymized data. The processing is carried out in particular for the purpose of sending you personalized advertising in accordance with Section 2 or displaying it on one of our portals, as well as improving the security of our portals.
We are entitled to transfer your personal data to third-party companies (commissioned service providers) abroad, provided that this is expedient for the data processing described in this data protection declaration. These are obliged to protect data to the same extent as we are.
5. Right to Information, Correction, Deletion or Complaint
You have the right to assert your data protection rights at any time and to request information about whether and which personal data concerning you is processed by us. You can also have your personal data corrected, blocked or deleted at any time by written notification and appropriate proof of your identity to the following address: ideas@novidarte.ch
We reserve the right to correspond with you in this regard.
Please note that even after your request to block or delete your personal data, we may have to retain some of it within the scope of our legal or contractual retention obligations (e.g., for billing purposes) and, in this case, will only block your personal data to the extent necessary for this purpose.
Furthermore, the deletion of your personal data may result in you no longer being able to obtain or use the services you have registered for. Under certain circumstances, you have the right to request that we transmit your personal data to you or a third party designated by you in a common format.
You can object to the processing of your data for marketing and advertising purposes and the transfer of your data in accordance with sections 2 and 4 at any time by email.
Such an objection does not entirely exclude the collection of personal data. The objection only excludes that collected personal data cannot be processed anonymously for marketing purposes and also transferred to other companies for this purpose and analyzed by them.
In order to entirely exclude or at least reduce the collection of personal data, the steps mentioned in Section 8 regarding the deactivation of cookies must be followed. This may result in you no longer being able to obtain or use the services you have subscribed to. In addition, you have the right to lodge a complaint with the competent supervisory authority regarding data processing. You can do this with the supervisory authority at your place of residence, workplace or the place of the alleged data protection violation.
6. Retention period of your personal data
We store your data only as long as it is legally necessary or corresponds to the processing purpose. For analyses, we store your data until the analysis is completed. If we store data due to a contractual relationship with you, this data will be stored at least for the duration of the contractual relationship and at most for as long as limitation periods for possible claims by us run or legal or contractual retention obligations exist.
7. Data Security
We use appropriate technical and organisational security measures to protect your personal data stored with us against accidental, unlawful or unauthorised manipulation, deletion, modification, access, disclosure or use, and against partial or complete loss. Our security measures are continuously adapted and improved in line with technological developments. We accept no liability for the loss of data or its knowledge and use by third parties.
We also take internal data protection very seriously. Our employees and the service providers commissioned by us have been obliged by us to maintain confidentiality and to comply with data protection regulations.
8. Use of cookies
Cookies help to make your visit to our websites easier, more pleasant and more meaningful. Cookies are information files that your web browser automatically stores on your computer's hard drive when you visit our website. Cookies do not damage your computer's hard drive, nor do cookies transmit personal data of users to us.
For example, we use cookies to track who has visited our portal and to deduce how often certain pages or offers are visited, which parts of the portal are particularly popular and, more generally, how the portal is used. We use other cookies so that you can move freely on our portal and use its functionalities, for example when accessing areas protected by access.
Such cookies may also be necessary to use shopping carts or payment functions. 9. Use of tracking and analysis tools
The use of our digital offerings is also measured and evaluated by means of various technical systems, predominantly from third-party providers such as Google Analytics. These measurements can be anonymous or personalised. It is possible that the data collected by us or the third-party providers of such technical systems may in turn be passed on to third parties for processing. The most frequently used analysis tool is Google Analytics, a service of Google Inc. This allows the collected data to be generally transmitted to a Google server in the USA, whereby the IP addresses are anonymised by means of IP anonymisation so that no assignment is possible.
The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data. 10. Plug-ins and other integrations of third-party offerings
Our digital offerings are linked in many ways with third-party functions and systems, for example by integrating plug-ins from third-party social networks such as Facebook, Google Plus or Twitter.
If you have a user account with these third parties, these third parties may also be able to measure and evaluate your use of our digital offerings. Further personal data, such as IP address, personal browser settings and other parameters, may be transmitted to these third parties and stored there. When using a social login service such as Facebook-Connect, the provider can transmit personal data such as name, email address and profile picture stored about you to us. We have no control over the use of such personal data collected by third parties and assume no responsibility or liability. We refer to the detailed further information linked above.
11. Legal basis
We only process your personal data within the framework of the data processing principles and if there is a legal basis. Where it serves the initiation and processing of our contract, this legal basis applies. Otherwise, we have an interest in continuously improving our offers, adapting them to your needs and showing you advertising that might be of interest to you. This is a necessity to further develop our offers, to be able to finance them and to ensure the security of our offers. We assume that our interests outweigh yours. If you have consented to data processing, this applies.

13. Timeliness and changes to the data protection regulations
Due to the further development of our website or the implementation of new technologies, it may become necessary to change these data protection regulations. Any significant change to the data protection regulations will be communicated to registered users by e-mail to the e-mail address provided during registration or by a corresponding notice at an appropriate place after logging into the user account.
The current data protection regulations can also be accessed and printed by you at any time on our website. Should we provide the data protection declaration in other languages than German, the German version shall be legally relevant.
